What is involved in estate administration in Thailand?

Thai estate administration typically involves identifying the estate's assets and liabilities, locating the will (if one exists), applying to court for appointment of an administrator where required, transferring assets to heirs, and settling any outstanding obligations. The process can vary in length depending on the complexity of the estate and whether there are any points of disagreement among heirs.

Does Thailand require a will to be in a particular form?

Thai law recognises several forms of will, including a holographic will written entirely by hand and a witnessed will signed in front of two witnesses. Each type has specific requirements under the Civil and Commercial Code. A will that does not meet these requirements may not be enforceable, which is why it is worth having documents prepared or reviewed by someone familiar with Thai inheritance law.

How long does the estate process usually take?

Timelines vary considerably. A straightforward estate with a valid will and cooperative heirs might be resolved within a few months. More involved matters — particularly those requiring court proceedings or involving property — can take longer. We will give you a realistic sense of the likely timeframe at the initial consultation, so you know what to expect.

Can a foreigner inherit property in Thailand?

Foreign nationals face certain restrictions on owning land in Thailand. However, there are legal structures — including condominium units, leasehold arrangements, and company structures — through which property may pass between generations. What happens if someone dies without a will in Thailand?

Where there is no will, the Thai Civil and Commercial Code sets out six classes of statutory heirs — spouses, children, parents, and more distant relatives — and defines their respective shares.
